Special Council Meeting Wednesday, November 20, 2002 Meeting called to order by Mayor Robert E. Cochrun. Roll Call: John Synodinos present, Dave France present, Dave Smith present, Robert Martin Sr. present, Beth Rupert present, Gene Pool absent. Officials: Mayor Robert E. Cochrun present, Solicitor Christopher D. Becker absent, Clerk Treasurer Mike Payne present, Administrator Gary R. Folden absent. Moment of Silence Pledge of Allegiance Reading of Minutes Motion by Robert Martin Sr., second by Dave Smith to approve the minutes from the regular Council meeting held Thursday, November 7, 2002. Vote: John Synodinos yea, Dave France yea, Dave Smith yea, Robert Martin Sr. yea, Beth Rupert yea. Motion passed 5-0. Persons Appearing before Council Brian Linkesh, representing McKitrick-Harms Oldsmobile Inc., said that the dealership had purchased the property between State Route 43 and Two Ridge Road previously owned by Clayton Homes. He said that the dealership owners were hoping to have a right turn in and out of their new location in relation to Route 43. Greg Gurney, ODOT Representative, said that approval for this request was up to the Village to grant, but he was not in favor of this turning scheme because it would slow down traffic in this area. He said that the primary purpose of the Route 43 project is to facilitate traffic from Wal-Mart and additional entrances would hamper the traffic flow. He did say that this entrance would only be a minor volume problem if the car dealership generated relatively low volume traffic and that no tractor-trailers used this entrance. John Synodinos asked if the Village could allow only traffic to McKitrick-Harm's dealership access to this turn off of Route 43 and cancel this permission if McKitrick-Harms went out of business and also prohibit any tractor-trailer traffic from King's Restaurant to use this turn in and out to 43. Greg Gurney said that the Village could put those restrictions on the entrance, but he still would recommend against allowing this entrance since it would still create a minor traffic problem. Chief Ed Laman suggested that McKitrick-Harms put up a gate so that road between Two Ridge and Route 43 would be closed during times when the dealership was not open. Pat McKitrick said that they would agree to do this. Beth Rupert asked Greg Gurney if there would be any consequences if the Village approved this turn in, against the wishes of ODOT. Greg Gurney said that there would be none, except that there may be some additional traffic congestion. Motion by John Synodinos, second by Robert Martin Sr. to permit a right turn in and out of the property provided that no tractor trailers be permitted to make these turns to and from King's Restaurant and that a gate be placed to avoid traffic from Two Ridge to 43 through the car dealership property during hours that the business was closed. Vote: John Synodinos yea, Dave France yea, Dave Smith yea, Robert Martin Sr. yea, Beth Rupert yea. Motion passed 5-0. Gary Armentrout, Citgo and King's Restaurant owner, complained that the new construction on Route 43 would not give his gas station the same convenient access that he currently enjoys. Greg Gurney explained why the design had been drawn the way it was and why another red light would not work close to his location. He said that the drawings and plans were still in the draft and discussion phase and that alternatives could still be looked at. However he said that any modifications would have to work with the entire traffic pattern as well as meeting certain warrants established. He said that putting an additional light at this area would be an ODOT decision. Beth Rupert asked if the reason for not putting in another light could be put in writing to the Village. Greg Gurney said that he would have the engineering consultant address this issue. Joe Elias, complained about the methane smell around the Briarwood homes and Two Ridge Road area. He said that the problem has been going on for about seven months. Beth Rupert said that the Village would meet with County Officials and try to take care of this problem. She also said Council had only been made aware of this problem at the previous meeting two weeks earlier. Pat Davis, repeated his promise to reimburse the Village for an odor and gas detector when purchased. Dave Smith excused himself from the remainder of the meeting. Reading of Ordinances and/or Resolutions Ordinance 2002-24: An Ordinance approving the permanent appropriations for 2003 was read for the second time. Reports, Announcements and Communications Mayor Cochrun announced that Village Offices would be closed on Thursday, November 28th, and Friday, November 29th in observance of Thanksgiving. Mayor Cochrun announced the sanitation schedule for the week of Thanksgiving. Mayor Cochrun said that the annual Holiday Parade would be held November 23, 2002. Mayor Cochrun said that the Ray Laman Children's Christmas Party would be held Saturday, December 14, 2002 at 10:00 AM. At St. Florian Hall. Committee Reports None. Old Business John Synodinos reminded Council that the lease agreement on the Village Property on Woodridge would be expiring on February 1, 2003 and that Council needed to decide on which option they wanted to take on this property. Motion by John Synodinos, second by Robert Martin Sr. to go out to bid for leasing the Woodridge property with a minimum bid of $500 per month. Vote: John Synodinos yea, Dave France nay, Robert Martin Sr. yea, Beth Rupert nay. Mayor Cochrun broke the tie by voting yea. Motion passed 3-2. Beth Rupert said that Attorney Jane Keenan had contacted her about sewer lines being backed up again on the property behind McDonalds. Beth asked Tammy Plante to inform the Administrator about this problem. New Business John Synodinos said that he would like to apologize for the mistake that he made in his recent editorial. He said that his editorial stated that Dan Wood was to be in charge of the combined Fireworks and Community Days Event and that this is not what was decided and that this was a misunderstanding on his part. He said that he has since learned that Mr. Wood would only chair the fireworks part of the event. John Synodinos said that because he was limited in the length of his editorial he was not able to make his point that businesses would not benefit from a combined event held outside the Village. John Synodinos said that he would like to obtain a complete listing of the income and expenses of the Fireworks event from this year. Dave France said that Dan Wood had already provided a complete statement at a finance committee meeting. He said that John Synodinos was at the meeting and saw the financial statement. John Synodinos said that he did not remember seeing the statement. Dave France and Dan Wood said that they would make a copy of the statement for him. Robert Martin Sr. said that this year's Community Days took a lot of work and to move it outside of the Village would not be a good thing. He said business would not benefit from having the event outside the Village. He said the village would also loose the benefit of the transformers that was purchased for the event.
