Regular Council Meeting Thursday, November 17, 2005 Mayor Dave France called the meeting to order. Officials: Mayor Dave France present, Solicitor Christopher D. Becker present, Clerk Treasurer Mike Payne present, Administrator Walt Ziemba present. Moment of Silence Pledge of Allegiance Reading of Minutes Motion by Thomas Bottorf, second by John Synodinos to approve the minutes form the regular Council meeting held November 3, 2005. Vote: John Synodinos yes, Dr. Robert Price yea, Thomas Bottorf yea, Robert Martin Sr. yea, Matt Parise yea, Dave Smith yea. Motion passed 6-0. Persons Appearing before Council Robert Laukert, BHJ Representative, updated Council on the recent BHJ Meeting. His update included information on the bridge situation, widening Route 43 and transportation studies. Mayor Dave France announced that Thomas Bottorf and Robert Laukert would remain as Village representatives in 2006 for BHJ Meetings. Reading of Ordinances and/or Resolutions Ordinance 2005-33: An Ordinance to approve the permanent appropriations for 2006 was read for the 2nd time. Ordinance 2005-34: An Ordinance enacting a new section for non-read water meters was read for the 1st time. Ordinance 2005-35: An Ordinance increasing the pay of all full and permanent part time employees and Auxiliary Police officers by 3% was read for the 1st time. Ordinance 2005-36: An Ordinance repealing one water meter in multi-tenant buildings was read for the 1st time. Motion by Robert Martin, second by Thomas Bottorf to suspend the rules for the 2nd and 3rd readings of Ordinance 2005-36. Ordinance 2005-36: An Ordinance repealing one water meter in multi-tenant buildings was read for the 2nd and 3rd times. Motion by Thomas Bottorf, second by Dr. Robert Price to approve Ordinance 2005-36. Chris Becker stated that his opinion was that businesses would not be grandfathered on any legislation on this Ordinance. Reports, Announcements and Communications Mayor Dave France announced that the annual holiday parade would be held November 19th beginning at 10:00 AM. Mayor Dave France announced that Village offices would be closed November 24th and 25th for the Thanksgiving Holiday. Mayor Dave France announced the sanitation schedule would be moved up on day for residents whose trash pickup was normally Tuesday through Thursday. Robert Martin Sr. suggested that residents received some type of notice regarding these changes in Sanitation schedule other than a reminder on their water bill. Mayor Dave France asked Council to consider purchasing an ad in the Indian Creek Basketball schedule. Motion by Robert Martin Sr., second by John Synodinos to purchase a $40.00 ad in the 2005-2006 Indian Creek High School Basketball program. After a brief discussion on the motion, the motion was rescinded and Mayor Dave France said he would use his Miscellaneous expense line item to purchase the ad. Administrator Report Walt Ziemba presented the two proposals for pipe for the Beechwood/Floyd project. He said he had already ordered the pipe to lock in the price and asked Council to approve the purchase after the fact. Motion by Robert Martin Sr., second by Matt Parise to approve the purchase of the pipe for the Beechwood and Floyd projects from James M. Cox Company in the amount of $55,105.18. Walt Ziemba said that the had received a letter from the Ray Laman Children's Fund Committee asking for donations for this year's Christmas Party. Mike Payne said that the Village had usually given $500 for bills involved in this event. Motion by Matt Parise, second by John Synodinos to pay bill toward the Ray Laman Children's Christmas Party not to exceed $500.00. Walt Ziemba said that he had submitted four (4) projects requesting for Issue II funding for 2006. Walt Ziemba said that he had an annual meeting with Sara Wallace concerning various water issues. One recommendation from this meeting was for the Village to look at raising the cost of tap-in-fees, since the current fee structure does not cover the Village's costs. Walt Asked Council to approve the purchase of a grinder for the influent tank at the sewer plant. He said that the grinder runs continuously through out the year and had never been replaced. He estimated the cost to be slightly over $900.00. Motion by Thomas Bottorf, second by Matt Parise to purchase a grinder for the sewer plant not to exceed $10,000. Walt Ziemba also said that the Ohio EPA wants the Village to paint and inspect its water tower. Walt Ziemba said that more reports needed to be done on line by the Water Department and that additional Internet connections and PC's may need to be purchased. Unfinished Business Thomas Bottorf said that a water committee meeting had been held. At the meeting it was determined that the problem with the current hand held water meters was a software issue. He said that Matt Parise would be working on a draft of an Ordinance for discounting the sewer portion of resident's water bills when a water break was involved. New Business Robert Martin Sr. discussed potential problem at the sewer plant that could be caused by items falling in the manholes. Walt Ziemba said he would follow up on this matter. Matt Parise asked how much more the Village should expect to pay to Dennis O'Toole regarding the Steubenville lawsuit. Chris Becker said that his rough estimate was that the cost for oral arguments should not exceed $5000.00. Matt Parise asked for copies of attorney bills on this matter. Matt Parise said that he had received complaints of speeding on Springdale and Winters Drive and asked Chief Laman to consider stepping up patrols in that area. Chief Laman said he had already took care of this matter. Matt Parise gave an update of the recent WABA Committee meeting. He said that the Christmas parade and tree lighting ceremony were items discussed at the meeting. Motion by Thomas Bottorf, second by Dr. Robert Price to increase Jeannie Wilson, Part time secretary to $10.00 per hour beginning in 2006 instead of the 3% and longevity raise given to other employee and to keep her weekly hours at 30 or less. Council and the Solicitor briefly discussed the fact that no penalty currently existed for businesses who did not comply with the Village's Parking lot Ordinance. Chris Becker said he would draft a revised Ordinance to address this situation. Thomas Bottorf requested that the light at the side of the building be replaced. Motion by John Synodinos, second by Robert Martin Sr. to pay bills as funds become available. For the Good of the Village Betty Stinard, Powell's Lane, thanked the Village employees for the excellent work done on her street.
