Regular Council Meting Thursday, October 20, 2005 Mayor Dave France called the meeting to order. Roll Call: John Synodinos arrived late, Dr. Robert Price present, Thomas Bottorf present, Robert Martin Sr. arrived late, Matt Parise present, Dave Smith present. Officials: Mayor Dave France present, Solicitor Christopher D. Becker present, Clerk Treasurer Mike Payne present, Administrator Walt Ziemba. Moment of Silence Pledge of Allegiance Reading of Minutes Motion by Dr. Robert Price, second by Thomas Bottorf to approve the minutes from the Regular Council Meeting held Tuesday, October 4, 2005. Vote: Dr. Robert Price yea, Thomas Bottorf yea, Matt Parise yea, Dave Smith yea. Motion passed 4-0. Persons Appearing before Council None. Reading of Ordinance and/or Resolutions Ordinance 2005-32: An Ordinance changing sewer rates for customers with multiple users with single water meters was read for the first time. Robert Martin arrived at the meeting at this time. Motion by Matt Parise, second by Dr. Robert Price to suspend the rules for the 2nd and 3rd readings for Ordinance 2005-32. Vote: Dr. Robert Price yea, Thomas Bottorf yea, Robert Martin Sr. yea, Matt Parise yea, Dave Smith yea. Motion passed 5-0. Ordinance 2005-32: An Ordinance changing sewer rates for customers with multiple users with single water meters was read for the 2nd and 3rd times. Reports, Announcements and Communications Mayor Dave France reminded residents that "Trick or Treat" hours for Halloween would be 5:30 to 7:30 PM. On October 31, 2005. Robert Martin Sr. also reminded residents that a Halloween party would be held that same night from 6:30 to 9:30PM at the Elementary school. Thomas Bottorf said that the Finance Committee had met on Tuesday, October 18th and would be meeting again on Thursday, October 27th at 6:00 PM to continue the budget process. Administrator's Report Walt Ziemba said that the Village had received a check for a 2% rebate of Workers Comp. Premiums for attending at least 10 of the 12 meeting held by the Safety Council. Walt Ziemba told Council that a copy of the letter sent to Judge Bednar, concerning the motion approved by Council regarding the proposed rental rates, was included in their packets. Walt Ziemba said that he had given Council a copy of the letter from the County Health Department regarding Mr. Sherrin's water connection. Walt Ziemba said that he had included a copy of the letter from the Village's insurance carrier denying a recent claim that occurred July 24, 2005, concerning Shawn Porreca. Walt Ziemba told Council that he had included a copy of the most recent legal correspondence (Briefs) that had been submitted by the Village's Attorney, Dennis O'Toole regarding the lawsuit against the village by the City of Steubenville. Walt Ziemba said that residents should support Issue I on the November ballot because it would continue to offer opportunities for the Village to receive grants in the future for various projects. He cited the $242,000 in grant funds the Village had received recently as an example of this funding provided by this Issue. He also added that it would not increase the residents taxes if passed. Walt Ziemba said that the Beechwood Ravine and Floyd Street I & I pre-bid meeting would be held October 25th at 10:00 Am and that at least 6 contractors had picked up the bid specifications on the project. Walt Ziemba said that the milling on Winters Drive and Rex Avenue had started today. He also said that the Troy Place drainage project was completed except for some minor clean-up and patching to be done. Unfinished Business Walt Ziemba said that he had given a description of the telemetry project to the Solicitor to help with the purchase agreement. He said that since the Village was purchasing more land than originally planned the cost would be a little over $5,000. Walt Ziemba said that no bids for renting the Woodridge property had been received. Thomas Bottorf questioned whether the previous renter had failed to pay all the rent due before leaving. Mike Payne said that the previous renter had only paid rent through April, even though they had a lease for at least through June or July. He said they were also delinquent in their water bills. Chris Becker said that the Village's best bet would be to take the renter to small claims court. Walt Ziemba said the would work on getting the information concerning the delinquent rent and water bills to Chris Becker. Motion by Robert Martin Sr., second by Matt Parise to re-advertise the Woodridge property for rent for $350 per month plus a security deposit of $350. Chris Becker said that he needed some additional details regarding the preparation of an Ordinance of waiving 25% of residents sewer bills when they encounter some sort of water break situation. Council decided to have this issue discussed at the next water and sewer meeting. New Business Robert Martin Sr. said he was looking for Volunteers to help with the Halloween party on October 31st. He said that preparations for the party would start around 4:00 PM. Matt Parise thanked the Police Chief for installing a no parking sign on Walnut Street. Thomas Bottorf, second by Dave Smith to hold a meet the Candidate night at the Village building on November 1st. Discussion on the Motion: Dave Smith said that he would be out of town on November 1st. Thomas Bottorf said that the date could be flexible and the maybe it could be held after the Council meeting was over on Thursday November 3rd. Matt Parise said that he did not think the Village could sponsor a political event such as this. Chris Becker said that the was not sure whether the Village could sponsor this event but he did not think the Village could spend any funds towards any food for the event. Matt Parise said that he had experience in these types of events and that a moderator would be needed if there would be any type of format involving questions or formalized speeches by the candidates. He also said that parameters would need to be established ahead of time for all candidates to know the format. Thomas Bottorf said that maybe a more social type of event would work so that residents could have a chance to meet the candidates. Mayor Dave France suggested that Thomas Bottorf and Parise work on this project together. Thomas Bottorf modified his motion to hold the meet the candidate night after the November 3, 2005 Council Meeting. Mayor Dave France said he talked to the Village's Insurance Company regarding the Wintersville Area Business Association becoming an ad hoc committee of the Village in order to fall under the Village's insurance policy and got the approval from O'klok-Chris to do this at no additional cost to the Village. Motion by Robert Martin Sr., second by John Synodinos to accept the former Wintersville Area Business Association group as an Ad Hoc committee of the Village. Chris Becker said that he did not have any problem from a legal stand point for the creation of this committee, but recommended that at least one Council member be a part of the committee and that the meeting be sunshined, similar to other committee meetings. Mayor Dave France said that he was nominating Texiana Branch as Chairman of the new committee and Heather Cipriaini as secretary for the committee. He said that Matt Parise and Thomas Bottorf would represent Council on the committee and that their first meeting would be held Tuesday, October 25 at Noon. The Mayor said that for now the name of the committee would be called the Wintersville Betterment Committee. Mayor Dave France announced that the next meeting would be moved up to 6:00 PM on Thursday November 3, 2005. Motion by John Synodinos, second by Dr. Robert Price to pay bills as funds become available. For the Good of the Village Cheryl Bowles, 434 Fernwood Road, complained about the noise made by a construction company who was working late hours near her house. Ed Laman said he would talk to the company about quitting at a normal time. Betty Stinard, Powells Lane, complained about slag from her driveway being washed away. She also said that the catch basin in front of her house was removed when the new fire hydrant was installed. Walt Ziemba said that he had talked to Mrs. Stinard about this situation and that this matter was on the Village's list of projects to work on. He said that the situation would be taken care of within the next two weeks. Motion by John Synodinos, second by Dr. Robert Price to adjourn..
