Regular Council Meeting Thursday, October 4, 2007 Mayor Dave France called the meeting to order. Officials: Mayor Dave France present, Solicitor Christopher D. Becker absent, Clerk Treasurer Mike Payne present, Administrator Walt Ziemba present. Moment of Silence Pledge of Allegiance Matt Parise arrived at this point in the meeting. Reading of Minutes Motion by Thomas Bottorf, second by Robert Martin Sr. to approve the minutes from the Regular Council Meeting held on September 20, 2007. Persons Appearing Before Council Jay Dziewatkoski, Karen Place, said that he had a proposed schedule of how the new Police Levy was going to be spent and inquired if this was the plan that Council was going to follow regarding Police Salaries. Thomas Bottorf told Mr. Dziewatkoski that the schedule that he had was not the schedule that the Finance Committee had available when the levy was agreed to be placed on the ballot in May. Reading of Ordinances and/or Resolutions Ordinance 2007-18: An Ordinance changing the discount on Sewer Bills was read for the second time. Motion by Robert Cochrun, second by Robert Martin Sr. to suspend the rules and waive the third readings of Ordinance 2007-18. Ordinance 2007-18: An Ordinance changing the discount on Sewer Bills was read for the third time. Motion by Matt Parise, second by Robert Cochrun to approve Ordinance 2007-18. Reports, Announcements and Communications Mayor Dave France read the September 2007 Magistrate, Police, and Code Enforcement Officer Reports. Mayor Dave France announced that Trick or Treat hours for Halloween would be held on Wednesday, October 31 from 5:30PM to 7:30 PM. Thomas Bottorf said that the change in Daylight savings time meant that a large portion of the trick or treat hours would occur before dusk. Mayor Dave France announced that the Village offices would be closed on Monday October 8, 2007 in observance of Columbus Day. Administrator Report Walt Ziemba explained a letter that he recently sent to ODOT officials which asked various questions or concerns that business owners have regarding the construction taking place along the one half mile stretch of the road. Walt Ziemba said that the Village may work with L & M Satellite Company on a trial basis concerning internet access. Walt Ziemba described several projects that will be proposed in the budget process for 2008 including resurfacing Woodland Park, drainage and road widening of Church Street, reconstruction of Luray Drive and to make a storage tank renovations. In addition to these projects he also said that replacing a 2 inch water line on School and Marshall Streets would be part of his 2008 projects. Walt Ziemba reviewed with Council how the fee structure for the JCSWCD agreement was arrived at. Walt Ziemba said that Garden Drive and Meadow Road and also Crawford Ave. and Moore Street would be paved over the next few weeks. Walt Ziemba said that during the recent smoke testing done in Sunset Gardens, 18 homes had violations and had been sent certified letters notifying the residents that they must correct these violations. Robert Martin Sr. said that residents in the Sabina Drive area were questioning the need for ODOT to complete the restoration of their properties. Walt Ziemba said that he would follow up with the situation. Walt Ziemba reported that a DHL truck had backed into a Village truck. He said that this incident had been turned into the Village's insurance company and that he is considering whether to have the truck repaired with the proceeds or to use the money for a replacement vehicle. Walt Ziemba said that the Wintersville Holiday Parade would he held on Sunday November 25 at 4:00 PM. Thomas Bottorf questioned whether the Village wanted to incur the expense of surveying the Village property on the right of way issue until the three readings, since a property owner may object to the ordinance. Robert Martin Sr. said that the Village needed to have this area surveyed anyway and his preference was just to have it done now. Unfinished Business Walt Ziemba said that he was going to be working on a revised policy for reimbursement of expense for employees who were taking different examinations related to their jobs. New Business Robert Martin Sr. questioned why the car lot on Route 43 was allowed to have a trash dumpster that was not picked up by the Village. Walt Ziemba said that he was aware of the situation and had communicated with the car lot. He said that Chris Becker would have to determine what legal action could be done to prevent the business from using this type of dumpster. Matt Parise said that he had been getting a lot of complaints about speeding on Winters Drive and Starkey Blvd., Springdale Ave., and Locust Street. Chief Laman said that he was currently addressing the situation. Jason Mattern asked if a sign informing motorists of the new Jake Brake Ordinance had been ordered. Walt Ziemba said that signs had been ordered for this. Thomas Bottorf reported that he had attended the recent BHJ Meeting and that at that meeting Jim Branigan told him that the Village may save on some expenses relating to paving old Route 22 by utilizing the same company they were using at the same time. Motion by Thomas Bottorf, second by Jason Mattern to credit all residents in Meadow Road and Garden Drive 1000 gallons on their November water and sewer bills in case they needed to power wash their homes due to all the dirt and dust created during the construction this summer in this area. Discussion on the motion: Robert Martin Sr. said that the Village should be prepared to offer this credit to other areas in the Village when similar work is done. He also suggested that the roads would be less dusty if they were watered down during the construction work. Matt Parise asked if the attorney bill regarding the Chase Bank Loan had already been paid since the backup information with the bills said that it was a second notice. Mike Payne said that this was the first copy of this bill that his office had received and that it had not been previously paid.
