Regular Council Meeting Thursday, August 1, 2002 Meeting called to order by Mayor Robert E. Cochrun Roll Call: John Synodinos present, Dave France present, Dave Smith present, Robert Martin Sr. excused, Beth Rupert absent, Gene Pool present. Officials: Mayor Robert E. Cochrun present, Solicitor Christopher D. Becker present, Clerk Treasurer Mike Payne present, Administrator Gary R. Folden present. Moment of Silence Pledge of Allegiance Reading of Minutes Motion by John Synodinos, second by Dave France to approve the minutes of the regular Council Meeting held Thursday, July 18, 2002. Vote: John Synodinos yea, Dave France yea, Dave Smith yea, Gene Pool yea. Motion passed 4-0. Persons Appearing before Council Dan Wood, Chairman of Thunder in the Ville, restated his position of not being in favor of having beer at the Community Days that he had discussed at the precious Council Meeting. He then complained of being harassed by John Synodinos regarding his position on the Community Day event. He also said that Mr. Synodinos told him that he would no longer support the fireworks event because of his position on the Community Day event. Mr. Wood also stated that Mr. Synodinos stated untruly that he was taking his stand on the Community Days at the urging of Beth Rupert and Gene Pool in an effort to sabotage the up coming event. Mr. Wood said that he had filed a report with two law enforcement agencies against Mr. Synodinos for his conduct towards him. Dan Wood concluded by asking for a public apology by Mr. Synodinos and his resignation as a Councilperson. John Synodinos responded by saying that he only contacted Mr. Wood to obtain information regarding the total cost of Thunder in the Ville for his letter he was writing to the editor of the Herald Star. He said that he sticks by all the statements he made to Mr. Wood. He said that he was irritated at Mr. Wood because of his comments about supporting a boycott of the Community Days event even though he and the other Council Members had always supported his fireworks event. He said that his feeling about previous Councilpersons were known and that he had voted against them and had encouraged his friends to vote against them as well. He also said that his comment about Mr. Wood's position on the Community Days event biting him in the ass was not a bodily threat. John Synodinos then explained that Robert Martin Sr. was not at the meeting this evening because he was working on last minute preparations for the Community Days. Gene Pool said that he believed that John Synodinos should be censured under rule 21 of the Council Rules of Conduct for his treatment of Mr. Wood. Motion by Gene Pool, second by Dave France to have the personal conduct committee review the allegations made by Mr. Wood against John Synodinos. Vote: John Synodinos nay, Dave France yea, Dave Smith yea, Gene Pool yea. Motion passed 3-1. Gene Pool asked that the committee meet prior to the next Council meeting. Dave France stated that he felt that every precaution was being taken concerning the serving of beer at the Community Days event. Reading of Ordinance and/or Resolutions Ordinance 2002-12: An Ordinance bidding out the 1997 Ford Crown Victoria was read for the 3rd time. Motion by John Synodinos, second by Gene Pool to approve Ordinance 2002-12. Vote: John Synodinos yea, Dave France yea, Dave Smith yea, Gene Pool yea. Motion passed 4-0. Ordinance 2002-13: An Ordinance certifying delinquent water fees to taxes was read for the 2nd time. Ordinance 2002-14: An Ordinance certifying delinquent sewer fees to taxes was read for the 2nd time. Reports, Announcements, and Communications Mayor Cochrun read the July Magistrate's Report. Mayor Cochrun read the July Building Inspectors Report. Mayor Cochrun announced a planning commission Meeting on August 6, 2002 for a fence variance for Joe Savage and John Petrella for a variance and plat amendment for property on Avalon Estates. Gene Pool asked for a temporarily replacement on the public conduct committee for John Synodinos. Mayor Cochrun said that he would pick a name out of a hat of the remaining councilpersons to temporarily replace John Synodinos on the public conduct committee. Robert Martin Sr. name was selected by using this procedure. Committee Reports John Synodinos said that he felt that the Community Days event should break even. He also said that he would like to publicly thank all those people who had helped with the event, including Gene Pool and Robert Martin Sr.. Motion by Dave France, second by Gene Pool to transfer $7.20 remaining in the sidewalk grant back to the general fund. Vote: John Synodinos yea, Dave France yea, Dave Smith yea, Gene Pool yea. Motion passed 4-0. Motion by Dave France, second by Gene Pool to increases the General Fund permanent appropriations by $100,000 for 2002. Motion by Dave France second by John Synodinos to increase the permanent appropriation in the sewer general Fund by $100,000. Vote: John Synodinos yea, Dave France yea, Dave Smith yea, Gene Pool yea. Motion passed 4-0. Motion by Dave France, second by Gene Pool to approve the budget transfers prepared by the Clerk/treasurer. Vote: John Synodinos yea, Dave France yea, Dave Smith yea, Gene Pool yea. Motion passed 4-0. Dave Smith stated that he believed that the Thunder in the Ville event should not be part of any discussion with the Community Days Event. He also expressed his displeasure with the article in the paper regarding the Community Days event. Motion by John Synodinos, second by Gene Pool to approve Gary Folden to proceed with contracting for architectural services with Ft. Steuben Engineering in the amount of approximately $6800 for the design of the new maintenance structure. Vote: John Synodinos yea, Dave France yea, Dave Smith yea, Gene Pool yea. Motion passed 4-0. Motion by Gene Pool, second by John Synodinos to proceed with expenses up to $10,000 for improving the ball field and roadway leading to the field owned by Dr. Petrolla. Administrator's Report Gary Folden said that he received a letter from Attorney Corabi regarding a 20-foot alley behind DaPeppino, which abuts with Canestraro and the Village's property. The letter inquired whether the Village would like to have the property deeded over to them in return for creating a right of way. Motion by Gene Pool, second by Dave France to accept this offer. Motion by John Synodinos, second by Dave France not to count Robert Martin Sr. as absent for the meeting tonight since he was working on the Community Day event. Gary Folden introduced a request for a crosswalk and blinking light to be put in on Fernwood Road near Dunlope-Shorac funeral home and their parking lot across the street. Chris Becker explained that the recent abandonment was rejected because Mr. McDevitt's description differed from the recorders office. He said that he would be bringing this up again at the next meeting. Mike Payne told Council Members that he had received complaints regarding the prescription drug plan for the employees and suggested that they explore alternative options with their insurance agent.
