Regular Council Meeting Thursday, July 5, 2007 Mayor Dave France called the meeting to order. Roll Call: Robert Cochrun present, Jason Mattern present, Robert Martin Sr. present, Bob Gale present, Matt Parise present, Thomas Bottorf present. Officials: Mayor Dave France present, Solicitor Christopher D. Becker absent, Clerk Treasurer Mike Payne present, Administrator Walt Ziemba present. Moment of Silence Pledge of Allegiance Reading of Minutes Motion by Robert Cochrun, second by Thomas Bottorf to approve the minutes from the regular Council Meeting held on June 21, 2007. Vote: Robert Cochrun yea, Jason Mattern yea, Robert Martin Sr. yea, Bob Gale yea, Matt Parise yea, Thomas Bottorf yea. Motion passed 6-0. Persons Appearing Before Council None. Reading of Ordinances and/or Resolutions Motion by Bob Gale, second by Matt Parise to table Ordinance 2007-11, regarding the updating of the RITA tax, indefinitely. Discussion on the Motion: Thomas Bottorf said that the Finance Committee had met with RITA Officials (Charles Hawk and Jim Newssmer) regarding the proposed Ordinance. They identified several items in the Ordinance that needed to be addressed. Matt Parise noted that the changes that will be made on the Ordinance will not deal with items that will be taxed. John Synodinos, resident and former Council person, asked if the Village had to follow the state language in the Ordinance regarding taxing things like dividends and gambling earnings. Thomas Bottorf said that the Village needed to pass something that followed RITA's rules, but could exempt whatever they wanted regarding what type of things were taxed. Reports, Announcements and Communications Mayor Dave France read the June 2007 Magistrate and Code Enforcements Officer's Reports. Mayor Dave France said he was overwhelmed with the success of the 4th of July Parade. He said he would like to thank all those who worked on the parade including Marci Zandarndo and Denise Martin and the Council persons Bob Gale and Robert Martin. Administrator's Report Walt Ziemba reported that the Demolition of the property at 131 Orchard Street had been completed. Walt Ziemba gave an update on Garden Drive/Meadow Road project including a summary of change orders involved with the project. Bob Gale asked that the Administrator present a break out of the entire project budget for Council and the Residents. Jason Mattern said that the communications regarding the Garden Drive/Meadow road project should improve over the remainder of the project. Walt Ziemba gave Council an update on the Park Hostess Program and asked Council for some additional funds for the activities involved with the Children. Robert Martin Sr. said that he did not have a problem with a small amount of additional funds being spent on this program. Walt Ziemba reported that $3850.00 had to be spent repairing a leakage around the sky lights of the municipal building. Walt Ziemba said that he would need to discuss water leaking at the Waste Water Plant at the next Finance Meeting. Walt Ziemba said that the Main Street paving project will begin on Sunday, July 8, 2007. He said that the crews would be working from 6:00 PM to 6:00 AM and would begin with milling work. Unfinished Business Walt Ziemba said that he checked with the Village's insurance agent concerning extending the health insurance from September to December 31st. The company asked if they could have additional information regarding employees before. Walt Ziemba said that he had sent a letter out to the trucking companies using Fernwood Road regarding the use of Jakes Brakes. New Business Council Members thanked all those involved who donated time and or money with making the Fourth of July Parade a success. Their thanks went out to all those involved including Village crews, the Police Force and the Betterment Committee members who helped. Jason Mattern congratulated Village employees Bruce Snider and Jack Herceg who successfully went thru a continuing education program that he administered to them. Thomas Bottorf asked that the Karen Drive water run off problems and other issues that were discussed by several residents during the Planning Commission meeting be addressed by the Village. Motion by Thomas Bottorf, second by Bob Gale to approve the transfers submitted by the Clerk Treasurer. In response to questions on bills from WC Cardinal Company and Sears, Walt Ziemba said that the Cardinal bill was for shelving at the water plant in accordance with an OSHA finding. He said that the Sears Bill was for new tools purchased that would be used for working on repairing equipment and pumps at the Water Plant. He said that these tools would be locked up separately at the Street Garage. Mayor Dave France thanked Jay Lapotte for his help in painting the benches at the Memorial Park. For the Good of the Village Robert Laukert commended Council for the installing of the banners throughout the Village. Robert Martin Sr. said that the Betterment Committee did all the work on this project. Mayor Dave France thanked Nancy Schloss from the Betterment Committee for all her work on this project. He said that she already had application for additional banners that would be ordered next year. Motion by Thomas Bottorf, second by Matt Parise to go into executive session to discuss Personnel and Pending Litigation manners.
