Council Meeting Tuesday, July 02, 2002 Meeting called to order by Mayor Robert E. Cochrun Roll Call: John Synodinos present, Dave France present, Dave Smith present, Robert Martin Sr. present, Gene Pool present, Beth Rupert absent. Village Officials: Mayor Robert E. Cochrun present, Solicitor Christopher D. Becker present, Clerk Treasurer Mike Payne absent. Administrator Gary R. Folden present. Kathy Collopy took the minutes for Clerk Payne. Moment of Silence Pledge of Allegiance Reading of Minutes Motion by Gene Pool second by Robert Martin Sr. to approve the minutes of the last Council meeting. Vote: Synodinos, abstain, Mr. France, abstain; Mr. Smith, yea; Mr. Martin, yea; Mr. Pool, yea. Motion passed 3-0 with 2 abstentions. Mayor Cochrun announced that there was a Councilperson from Bellaire, Ohio, Mrs. DeVienzo at the meeting. Councilwoman DeVienzo approached council and stated that she was happy to be in attendance and would observe the meeting. Persons appearing before Council Betty Stinard asked if anyone gave permission for the posting of all the signs on the poles in Wintersville. Mayor Cochrun and Council stated no. Betty Stinard requested the signs be removed she stated that they are unsightly and detract from the appearance of the village. After much discussion it was decided that there was not an ordinance prohibiting the posting of signs on poles. Mayor Cochrun requested that Chief Laman take care of the matter. Dwight Bowman, 120 Stardust Drive, Wintersville appeared requesting a break in his water and sewer bill when he goes away for the winter for 6 months. Robert Martin Sr. explained that an ordinance was passed about a month ago that the homeowner is to come to the water office when going away for a long period of time the water will be turned off and there is no charge. Mr. Bowman explained he was not aware of that. Chris Becker stated that it was passed April 18, 2002, and Mr. Bowman could request a copy of the ordinance. Mr. Bowman also stated that he called to have a seal put back on the meter and no one has yet taken care of doing it. Mayor Cochrun told him that Gary Folden would take care of that. Reading of Ordinances and Resolutions Ordinance 2002-09: 2nd Read, An ordinance to amend Section 941.02 U of the Codified Ordinances, Water Sewer Shut Off Ordinance. Ordinance 2002-11: 1st Read, An ordinance abandoning and vacating a road leading from Gumps Lane to Molinaro's Collision Center. Chris Becker stated that he a received letter dated, today, July 02, 2002, from Paul A. Molinaro, requesting that the alley behind the barber shop and going to his business be abandoned. Ordinance 2002-12: 1st Read, An ordinance declaring that pursuant to Section 721.15 of the Revised Code, a 1997 Ford Crown Victoria, 4.l6 liter engine, vin# 2FALP71W6VX182127 is no longer needed for municipal purposes and is authorizing the same for sale to the highest bidder, after advertising for 4 consecutive weeks. Reports, Announcements and Communications Mayor Cochrun read the Magistrate's Report for month of June 2002 Mayor Cochrun read the Building Inspector's Report for month of June 2002 Mayor Cochrun read the Police Report for the month of June 2002 Mayor Cochrun stated that the BHJ dues for 2003 of $813.40 were due Gene Pool made a motion to pay BHJ dues for 2003, Dave France second the motion. Mayor Cochrun announced the 4th Annual Thunder in the Ville will be Thursday, July 04, 2002 beginning at 2 PM. Gary Folden said that at 7 PM all fire fighters and emergency personnel will be honored and requested all of council attend and Congressman Strickland will also be in attendance. Mayor Cochrun announced that the village offices will be closed for the 4th of July. Mayor Cochrun stated that some of the employees had requested Friday off and asked council's permission. After much discussion it was decided that Friday would not be given as a holiday due to many employees had vacation days yet unused. Mayor Cochrun has received complaints about cats running at large. Mayor Cochrun reminded residents to keep their animals in their yards. Committee Reports Dave France stated that there was the transfer of monies from one account to another to adjust the Budget. Gary Folden stated that the Sanitation will be in the red at the end of the year. Several possibilities were discussed to help the sanitation from raising the rates to cutting expenses or privatizing the sanitation department. Mayor Cochrun stated when he came on council over 20 years ago it was privatized and the sanitation department was created to benefit both the village and the citizens. Mayor Cochrun went on to say that he feels that the price of the landfill is what is costing the village money. A motion was made by Dave France to transfer funds and second by Dave Smith as requested by the Clerk/Treasurer. Vote: John Synodinos yea; Dave France yea; Dave Smith yea; Robert Martin Sr. yea; Gene Pool yea. Motion passed 5-0. Robert Martin Sr. said that the Community Days slated for August 02, 03 and 04 is going quite well. Gary is getting the license for the liquor from the state and work has been started on getting the power. Gene Pool said that he has a price from AEP to install the electric service for community days. The price is $3000. for one (1) service. Robert Martin Sr. stated that one service will be needed Gene Pool stated that he would like to have a Recreation Committee Meeting sometime before the next scheduled council meeting. Gary Folden stated that it was not yet official but the village will be approved for the computer grant and he also stated that it looks like the village will be receiving the CDBG for the Knolls Project. Old Business Motion by Dave France, second by John Synodinos to proceed with the village garage. Vote: John Synodinos yea; Dave France yea; Dave Smith yea; Robert Martin Sr. yea; Gene Pool yea. Motion passed 5-0. Gene Pool asked Chief Laman if he had hired the new police officer. Chief Laman stated that he was still interviewing but would let council know when he does. New Business Chris Becker stated he did some research regarding the village's permit ordinance and individuals soliciting door-to-door and business-to-business. The present time the village has the individuals check with the village before doing this and after researching this believes the village should continue this practice. Mayor Cochrun discussed the lot clean up and wants to continue with the village's procedure of sending letters to the individuals who are in violation of the village's ordinance. Then if they fail to comply, have the property cut and certify the delinquency on their taxes. Chris Becker said we can give them notice to abate within ten days once they have been served or published. If they fail to cut the grass the village can cut the grass. The village can bring a civil suit or place it on their property taxes the same as we do with the past due water and sewer liens. Even if the property is sold the liens are included in the price, but if it goes to a sheriff's sale we do not see that money. The problem in cutting the grass is collecting the money once it is cut. Dave France asked if the village has a procedure to call the individual? Mayor Cochrun explained that a letter is sent or a call is made by the police department's beautification officer. Dave France asked if something could be implemented so that if the property owner went to build on that lot the cost be assessed to them at that time. Chris Becker said he could look into that issue and let him know at the next meeting. Motion by gene Pool, second by Robert Martin Sr. to pay the bills as funds become available.
